Frequently Asked Questions

Key clarifications regarding offshore lodgement, visitor visa travel during processing, and long-term waivers.

Yes. You may apply for a standard Visitor Visa (Subclass 600) to spend time with your partner in Australia while your Subclass 309 is being processed. Under current migration regulations, the Department can grant your Subclass 309 visa regardless of whether you are inside or outside Australia at the time of decision.

For de facto couples, you must generally prove at least 12 months of continuous cohabitation and exclusive mutual commitment prior to lodgement. Periods of physical separation due to work, travel, or immigration constraints can be considered provided there is clear evidence of ongoing mutual support and communication.

Yes. If you have been in a long-term relationship (at least 3 years of living together, or 2 years if you have a dependent child together) at the time you lodge your application, the Department can assess and grant both the Subclass 309 provisional and Subclass 100 permanent visas concurrently.
